Application of Fluorescence Spectroscopy in Chemical Oceanography: Tracing Colored Dissolved Organic Matter (CDOM) Erika Mae A. Espejo 3rd year, BS Chemistry, University of the Philippines, Diliman Abstract Dissolved organic matter (DOM), the fraction passing through a 0. 45 à µm membrane filter, is considered poorly understood mixture of organic polymers because of its complexity. Although it largely influences a lot of biogeochemical processes in aquatic environments, its characterization is not that simple.However, due to the fact that it comprises optically active fraction called colored dissolved organic matter (CDOM) together with the help of its colloidal components, tracing of DOM can be possible. Through different methods and instruments such as fluorescence excitation-emission spectroscopy, parallel factor analysis (PARAFAC), isolation-fractionation technique (pairing of fluorescence and absorbance spectroscopy), and satellite remote sensors, analysis of DOM can be done wh ich can help elucidate its dynamics in aquatic environments.Introduction When a molecule absorbs light (energy), an electron is excited and promoted to an unoccupied orbital. Figure 1 shows a Jablonski diagram which describes what happens when an electron is excited: Fig. 1 Jablonski diagram The energy difference between the ground (S 0) and excited singlet states (S1, S2 or higher) determines the wavelengths at which light is absorbed. Absorption (excitation) can result in a range of transitions to various vibrational sublevels of excited singlet states, which is then followed by nonradiative relaxation to the lowest sublevel of the S 1 state, via vibrational relaxation and internal conversion.Internal conversion, singletââ¬âtriplet intersystem crossing and fluorescence then compete for relaxation to the ground state (S 0). The wavelength of the fluorescence emission is determined by the difference in energy between S1 and S0 states. The greater the conjugation in the molecule, the lesser the difference in energy resulting in a longer wavelength of fluorescence. Discussion The fraction passing through a 0. 45 à µm filter includes material in true solution, together with some colloidal components, and is termed dissolved organic matter (DOM).It could be autochthonous/external (from degradation of terrestrial plant matter which is dissolved and transported through river systems and estuaries to the marine environment), or allochthonous/internal (from exudation by phytoplankton, excretion by zooplankton, and post-death organism decay process). DOM influences different aspects of aquatic environments like microbial and plankton (aquatic) ecology, trace metal speciation and transport, polycyclic aromatic hydrocarbons (PAHs) toxicity, trace water masses, mobilization of organic and inorganic pollutants, photo degradation, drinking water treatment, and carbon budgeting.This implies that tracing and characterization of DOM is essential to understand its dynamics ; however, since DOM is a complex and poorly understood heterogeneous mixture of aliphatic and aromatic polymers, and its composition varies in time and space depending on proximity to sources and exposure to degradation process, characterization is arduous (involves large sample volumes and many stages) [4]. The optically active fraction of DOM (passing through a 0. 2 à µm filter) is called the colored dissolved organic matter (CDOM). It absorbs ultraviolet and blue light radiation in 350-500 nm range and also fluoresces when excited by light .Its presence gives water a yellow/brown color (and often described as yellow substance or gelbstoff) and its light absorption is highest in the ultraviolet (UV) region and declines to near-zero levels in the red region of the spectrum [2]. It plays an important role in determining the underwater light fields, represents a significant component of ocean optical signals for satellite-based measurements of ocean color and can interfere in globa l and regional estimates of primary production; affects the ocean color, underwater light fields and aquatic chemistry through a suite of sunlight-initiated photochemical processes [3].Thus, using spectroscopy, it can be used as a tracer for the characterization of the DOM pool. This review discusses four approaches in fluorescence spectroscopy for tracing CDOM. The first one is the Fluorescence Emission-Excitation Spectroscopy. Fluorescence excitationemission matrices (EEMs) are emission scans from excitations over a range of wavelengths (? ) which provide information on number, types and abundance of fluorophores present in CDOM [4] . It can also ifferentiate between CDOM of terrestrial and marine origin (marine CDOM has a fluorescence maximum at shorter wavelengths than terrestrial). For multivariate analysis of EEMs, Principal Component Analysis (PCA), a two-way data analysis method is used (for example 45 excitation ? times 150 emission ? equals 6750 variables). However, Stedmo n et. al said that Parallel Factor Analysis (PARAFAC) is better suited to EEMs since it is a three-way version of the PCA where the data are composed into tri-linear components. Equation 1 describes the PARAFAC model (the second approach): xijk = ? ifbifckf + ? ijk (1) where xijk is the intensity of the fluorescence for the ith sample at emission wavelength j and excitation wavelength k, aif is directly proportional to the concentration (moles) of the fth analyte in sample I, b jf is linearly related to the fluorescence quantum efficiency (fraction of absorbed energy emitted as fluorescence), ckf is linearly proportional to the specific absorption coefficient (molar absorbtivity) at excitation wavelength k, F defines the number of components in the model, and a residual matrix ? jk represents the variability not accounted for by the model. Figure 2 and figure 3 show that the model reproduces the main features of the measured EEMs when they sampled in the east coast of Jutland, Denma rk: This implies that PARAFAC modeling is an effective method of characterizing CDOM with EEMs. This approach was able to trace CDOM to help elucidate its dynamics: Stedmon et. al said that the model was successful in grouping the fluorophores present into groups with similar structure. They have found out that excitation at longer ? uggests that the fluorophores responsible for this fluorescence are more aromatic in nature or contain several functional groups, the ratio of fluorescence in this region (~500 nm) relative to the fluorescence at 450 nm, varies depending on the number of aromatic groups and, hence, the source of the material, and ratios twice as large in the estuary than in the terrestrial samples, suggests that the fluorescence is not only due to terrestrially derived matter but also CDOM produced/transformed in estuarine processes.As with the behavior of CDOM, results show that this approach distinguishing is capable between of CDOM derived from different sources sinc e there are considerable differences in the composition of CDOM from sources of DOM. Transported out of the forest and again autochthonous DOM during estuarine mixing (where the freshwater input from the stream mixes with the saline waters of the inner estuary) ?In freshwater: due to mixing (dilution), and degradation/transformation ? In forest stream: photochemical degradation due to exposure to sunlight (photochemical degradation bleaches the DOM fluorescence and causes the specific fluorescence to decrease) ? Results show that this approach enables us to establish relationships between general characteristics of the DOM pool and its fluorescent properties. The third approach is the isolation-fractionation based techniques ((ion-exchange resins, reverse osmosis, rotary evaporation, a nd tangential flow ultrafiltration).However this approach uses isolates which may not completely reflect the actual structure, behaviour, interactions and reactivity of DOM in the natural environment due to alterations in the structure of the DOM during extraction and concentration and due to their removal from the original environment in which they were situated. Nevertheless, the paired fluorescence and absorbance measurements can still distinguish CDOM from different sources. Figure 4 shows that DOC against a340 for all sample sites and demonstrates a strong correlation (r=0. 9, n=30); a340 was found to be the best proxy for DOC from all the optical measurements taken, where a340 is absorption coefficient at 340 nm (provide a check for inner-filtering effects when highly absorbent DOM quenches fluorescence, resulting in a decrease in intensity): Fig. 4 Relationship of DOC and a340 measured in River Tyne, northern England The last approach is through satellite remote sensing, a me thod that could estimate the amount of CDOM in surface waters over large geographic areas would be highly desirable.Satellite remote sensing has the potential to CDOM observation with high spatial and temporal resolution and enables scaling up to the level of large ecosystems and biomes which implies that match-ups have really high correlation (hence approach is [3] . Figure 5 below shows satellite measurements of CDOM successful and verified): Satellite-derived CDOM products will allow us to estimate processed such as ecosystem production of DOM and sunlight decomposition of CDOM [7] . The new odel will also allow us to validate the remote sensing estimates of phytoplankton (chlorophyll concentration) and productivity, and may open up new possibilities for using ocean color remote sensing with studies in areas such as photochemistry, the photobiology of ultraviolet radiation and even ocean circulation [3]. Conclusion The importance of CDOM in tracing and characterizing DOM has been showed through the use of its optical properties; thus enabling us to explain the dynamics of its pool.The use of fluorescence spectroscopy makes it possible to distinguish the properties of CDOM which can enlighten us on how it influences the biogeochemical processes in the aquatic environments (for example the absorbance measurements can tell us what components of CDOM are present, its molecular weight, it sources, etc), and how it behaves in different environments. I am also quite skilled in the use of powerpoint, so I included some very good effects that all group members were very happy to see. The virtual meetings were more challenging for all of us generally and for me in particular because my English is not very good. It takes me some time to organize my thoughts and opinions in the form of questions or suggestions and put them in front of others in English whereas my other group members were very fluent in English and so easily conveyed whatever they had in their mind. For instance, a neurosurgeon can achieve a higher status and class as they may be earning a higher income as compared to a general doctor at a local clinic situated in a local town. Another example may be that of a lecturer at a university and a teacher at a school, because a lecturer earns a higher salary as compared to a teacher his/her status is higher. Their level of education is also considered as the lecturer is usually more educated than a teacher, thus he/she earns higher prestige in an industrial society. Family status may also be another factor out of many which influences oneââ¬â¢s status or class. Taking for example, if an individual was to be born into a wealthy and influential family, they would have attained an ascribed status which could turn out to be a great advantage in the industrial societies. The individual has a privilege of learning at a well facilitated expensive school and also attaining a high rank as a managing director or even the C.E.O in the familyââ¬â¢s company or due to membership influence in another major company. This may result in one earning a higher status and class in the society. Occupation however, is sometimes not viewed as the major determinant of either social class or status as there are other factors like that of race amongst others. Race has always been a major factor of discrimination and segregation in societies, for example in Zimbabwe, during the liberation struggle black people were considered of being lower class, they occupied the lower class jobs, housings and many other underrated facilities as they were made to work for the white people who were their lords and only means of employment. This kind of unfair treatment brought the social class and status of black people down in the industrial societies, which therefore provides supporting evidence to Karl Marxââ¬â¢s conflict theory. Another example of racial discrimination still evident in most parts of the globe is that of employment opportunities, given a black man and a white man who just graduated from university with equal achievements and applied for a job vacancy at a major company. Th e white man is usually the first preference to the black man due to beliefs that whites are more superior, this kind of treatment surely lowers the status and class of blacks whilst raising that of the whites. Community size is another factor influencing oneââ¬â¢s status and class. The greater the community size, the greater the prestige it holds. For example, a professional accountant working at a small bank at a growth point like Murombedzi growth point is bound to achieve a lower status and social class as compared to an equally qualified professional accountant working at a big company like Econet or NMB bank in a huge city. In this case it can be reasoned that the social class and status were not determined by occupation but by location and community size. With the above information, one can conclude that occupation is in fact the major determinant of both social class and status in an industrial society. However, despite the seemingly convincing contributions of occupation in determining the class and status, it must not be left out that there are also some factors other than occupation like community size and race which also determine an individualââ¬â¢s social class and status in industrial societies.

As the nations first fertilizer brand, Engro (then Esso) helped modernize traditional farming practices to boost farm yields, directly impacting the quality of life not only for farmers and their families, but for the nation at large. As a result of these efforts, consumption of fertilizers increased in Pakistan, paving the way for the Companys branded urea called Engro, an acronym for Energy for Growth. As part of an international name change program, Esso became Exxon in 1978 and the Company was renamed Exxon Chemical Pakistan Limited. These days, gas prices seem to be a weekly topic on local and national news channels. Every time there is some type of fluctuation, it causes an uproar, usually because it is a difference of ten cents or greater. The reasons as to why is definitely a mystery with new myths popping up each day and almost all the supposed reasons being incorrect. The real discussion should be not as to what causes the price change but how it affects our everyday lives. Should we adjust our way of life to accommodate less driving or have we already? In the U.S., we saw gas prices go as low as $1.75 and as high as $3.00 in 2005. In 2006, we saw almost the same trend with a low of $2.10 and so far we have leveled out around $3.00 or so. While I can agree that $1.75 works a lot better on my budget with two kids and a lot of ground to cover in my SUV each day, there is actually some good reason as to why we see such change each year. The first and most obvious reason would have to be that during the winter months when we drive the least, prices drop to accommodate the resulting increase in supply and the opposite occurs in summer months when we drive the most. Another major cause in price change occurs when there is a change in value in crude oil, also dependant on the supply and demand factor. With many large worldwide issues such as weather and war affecting the supply, this can be part of the reason but is definitely not the main factor as many people believe. You may be pondering though, ââ¬Å"Why does the price of fuel go up with the price of each barrel but not back down with it as well?â⬠That is a simple answer as well ââ¬â supply and demand. With the prices rising, less gas is purchased during a time that the companies have to sell extra to make ... ...ust get in the car and drive for no reason? I definitely do not, I donââ¬â¢t have time too! And Iââ¬â¢m sure most other people donââ¬â¢t either. When we get in our cars, we usually have somewhere to be and I need groceries and I need to go to work so I canââ¬â¢t cut down on how much I drive even if I wanted to. So in conclusion, we should all quit blaming the politicians, who in fact have lowered the taxes by a small margin to assist during the hard times and the oil companies who have faced the largest ratio of production costs in history. So unless you can setup a carpool and split the cost of gas with others or are willing to utilize public transportation, there is no sense in worrying about what you can do because there isnââ¬â¢t much we can do. We should adjust our budgets and not our way of life because an increase in everyday life costs is inevitable and just a fact of life.

Pornography and Prostitution The topic that I have been researching for the past few weeks has been prostitution. It has been very interesting so far. The studies have shown just exactly what the problems with prostitution are. In some of the older books I read, historians were interested mainly in discussing the attitudes toward prostitution but in more recent work the focus has been on prostitutes themselves including their range of alternatives, their conditions of work, their health and life spans, their careers-and interaction between prostitutes and others, such as reformers, clients, or bosses. Studies about men and women, boys, and girls who have been involved in prostitution and/or pornography have revealed a lot. They are the hardest patients to treat. They say they want help, but nothing thatà ¾s done to help them out works. They run back. They just donà ¾t seem to want to change. Women who have been subjected to continuous abuse and victimization over which they have no control or understanding have developed a sense of psychological paralysis that prohibits their ability to do anything positive about further victimization. They believe they are unable to change their destructive behavior. They become entrapped in helplessness and hopelessness. They feel themselves to be out of control of their lives. Essentially, they have developed a chronic disorder as a result of their victimization and an inability to separate themselves from the sexual exploitation in order to make a better life for themselves. à In a recent study based on an analysis of 200 women street prostitutes, 78% reported starting prostitution as juveniles; and 68% were 16 or younger when they started prostitution. A majority of the juvenile prostitutes described family structures with the outward appearances of stability. Over three-fourths reported having a religious upbringing. Forty percent were raised by both mother and father. The younger the prostitute, the more educated the family. Yet, despite the religious, financial, and other appearances of success, the study revealed a number of problems occurring within the family. More than half the prostitutes had parents involved in excessive drinking. In over half the families the child saw the father hit the mother violently and 62% of the subjects were themselves beaten while growing up. Only in a few cases was the beating related to something the subject did. The most damaging psychologically are those cases in which the victims could not figure out why they were being beaten or those in which they were being beaten for no special reason.

The Truth Should Be Told, Whatever the Cost
Anisa Kornegay P. 7 Discursive Essay #2 ââ¬Å"The truth should always be told, whatever the cost. â⬠Itââ¬â¢s clear that in life you run into lies and you run into the truth but when is it morally ethical to not tell the truth, and when is it okay to lie? The truth has caused a plethora of controversy worldwide instances where it is concealed and when it is exposed. Subsequently the truth seems to always be told, when it is and even when it is not needed. In the medical realm the truth should be told, although in the past it has been covered up.Medical experiments frequently avoid telling the truth. For example in the Tuskegee Syphilis experiment in Alabama, 399 black men were told they were being treated for ââ¬Å"bad bloodâ⬠when in actuality they were in the late stages of Syphilis. By the end of the experiment 128 men died from syphilis, but if the doctors informed the subjects of the infection many lives could have been spared. Just like the Tuskegee Syphilis expe riment, in other occasions the truth should be told in the medical world.For instance, in Crisis Pregnancy Centers all over the United States also known as CPCââ¬â¢s pregnant women are told claims by the uneducated staff members to have them refrain from having an abortion because they believe abortion is wrong. One woman, Katy Stag went to three CPCââ¬â¢s in Ohio that told her ââ¬Å"There is more risk in having an abortion than carrying a baby full termâ⬠which is false; studies show that a woman who carries their baby full term are fourteen times more likely to die. This exemplifies that in the medical world that lies should not be told.Therefore, the truth should be told, especially in regard to anything medical. Along with the medical world, the truth should be told in regard to high government officials. Presidents should always tell the truth, one lie can lead a president to impeachment. For example, in 1974 President Richard Nixon of the United States was on the v erge of impeachment for obstructing justice. President Nixon hired men to illegally gain information on his opposing party. Nixon denied all involvement, even when evidence surfaced linking him to the crime.Just like President Richard Nixon Watergate scandal, other presidents have withheld the truth. For instance, Bill Clinton was impeached on the charge of obstruction of justice in 1998. The charges came from his sexual affair with his 22 year old intern at the time Monica Lewinsky, DNA evidence proved there was a sexual relationship even though President Clinton denied the allegations. His lie had him impeached. Evidently, the president of a country is one looked up to and should tell the truth. It doesnââ¬â¢t make a significance difference in citizensââ¬â¢ lives if an athlete lies.If the action of an athlete does not affect the lives of others the truth should not be of significance. For example in 1988, Gregory Louganis a diver in the Olympic Games, went to dive and hit hi s head on the platform, later the truth came out that he had HIV. AIDS expert Anthony Fauci, MD, assured everyone that Greg Louganis did not place any risk to the health of the other athletes on his decision to disclose his HIV diagnosis. Just like with Gregory Louganis other athletes have had the truth revealed when it was unnecessary.For instance, Marion Jones, 3 time Olympic gold medalist track star, plead guilty in 2004 to lying to federal agents about taking banned steroids, but it was proved her usage was not during any of the times she won her gold medals, so it did not change the Olympic results and she keeps her medals. Without the truth, nothing really would have changed. Subsequently, the lives of citizens are not affected when an athlete has lied about their situation leaving the truth better off not exposed. The effects of war or danger are a reason to withhold the truth. In warfare the truth is permitted to be disguised by lies to be loyal to your own country.For examp le, in the Cold war between NATO and the communist sect, people on each side of the war were prepared to betray their countries secrets, but would sacrifice themselves to protect their country. You do what you have to win the war for your country by any means, and if those means involve lying then so be it. A similar principle was present in the 1939; 45 year war giving out ââ¬Å"disinformationâ⬠was a key role in the war. Hitlerââ¬â¢s forces in France were deceived to think that the war was at the Pas de Calais rather than along the Normandy coast, England even created a fake army.This morale shows they did what they could to win the war. Undoubtedly, the danger of war outweigh telling the truth, thus it would be acceptable to lie. It is apparent that the truth has certain circumstances when it is to be exposed and when it is to be concealed. In medicine and at the head of government it seems the truth is to be told constantly. On the other hand, in sports and in warfare t he truth is not as needed. No matter what, one thing is certain, we as humans must learn the instances of when the truth should be told regardless of the consequences.

Analytical Examination Essay
This paper will analyze about the RA 10354 also called Responsible Parenthood and Reproductive Health Act of 2012. This essay will present a short history of the law here in the Philippines until it become enacted and implemented. This will discuss the major provisions of the law together with its important contents ranging from health care to contraception. This will also discuss the issues that are connected to this law while it was a bill such as maternal death, early pregnancy, premarital sex, poverty and population and reproductive health education. Issues concerned with legislation of the bill such as the necessity and morality of the bill and its contents like contraception and reproductive health education will be especially presented. Other news which may have affected the support for the bill will be also presented and analyzed. This will also present the major groups that approve or oppose the said law together with their reasons why they want or are against the said law. This will also talk about the actions those groups have taken for or against the law which may have affected the support for the billââ¬â¢s implementation. This is also concerned with the voices of certain world organizations such as UNESCO and WHO on reproductive health education and the stand of the Church on the matter about contraception, self-continence and marriage. This will be concerned about their statement about the matter and the doctrines and values they adhere with. Summary Since its first proposition on 1988, the Reproductive Health Bill experienced many debates if it was really needed here in the Philippines. The proposition was changed and improved by a number of proponents many times but was mostly neglected. Then, a similar bill was also introduced in the first regular session of the 14th Congress by Albay Rep. Edcel C. Lagman, Jannette L. Garin, Narciso D. Santiago III, Mark Llandro Mendoza, Ana Theresia Hontiveros-Baraquel and Elandro Jesus F. Madrona that was known as House Bill 5043. Like that of the former bills, it was also disposed but its proponents never stop to improve, change and remove some parts of the former bill to create a new one. Many times Albay Rep. Edcel Lagman and its principal authors would edit the bill until the Reproductive Bill of 2012 was formed. Senator Pia Cayetano was also a principal sponsor of such bill. Upon December 19, 2012, the Senate enacted the bill and on December 21, 2012, four days before Christmas His Presidency, Benigno Aquino III signed the bill and was to be implemented fifteen days after its official publication. The law was known as RA 10354 or Responsible Parenthood and Reproductive Health Act of 2012. Its major provisions are to promote and have access to reproductive health care and methods that are legal and safe, to promote family planning methods and responsible parenthood, to counsel women who committed abortion in a humane way, to mandate reproductive health education in age appropriateness to students, to supply and maintain reproductive health services to all, to protect reproductive health rights and to penalize those who restricts or prohibits the access to reproductive health care and methods stated in this law. The law mandates the hire of skilled health professionals for maternal health care and birth attendance, seen in Sec. 5. It also promotes the upgrade of health care facilities for obstetric and newborn care as stated in Sec. 6 and to access for family planning methods especially to the poor and marginalized couple and to sexually active minors as said in Sec. 7. The law also states that ââ¬Å"hormonal contraceptives, intrauterine devices, injectables and other safe, legal, non-abortifacient and effective family planning products and suppliesâ⬠(RA 10354, Sec. 9) should be treated in the Essential Drugs List after subjection to reputable medical associations. It also mandates the procurement and distributions of family-planning supplies and age appropriate reproductive health education, stated in Sec. 10 and 14 respectively. And lastly, to condemn any who shall prohibit the access to health care and family-planning supplies. Since its first introduction by Albay Rep. Edcel Lagman, this law had reaped many opposition and approval before being enacted. The pro-woman groups fought for saving the lives of woman from maternal death on the other hand the Church and other pro-life groups fought for dignity of the unborn and the sanctity of marriage. The senate itself was divided for selecting to if they will oppose or approve the bill. The Former President and Pampanga Rep. Gloria Macapagal-Arroyo was known to opposed the bill and be backed upon by the Church meanwhile President Benigno Aquino III shown agreement towards the bill and expected its implementation. The pronouncement of Pope Emeritus Benedict XVI to condoms also became news if the Church was open to contraception. This gave new hope for Edcel Lagman from acceptance of the Church but Paranaque Rep. Roilo Golez explained that the Pope talks about health, that preventing HIV from spreading is showing compassion but the Pope doesnââ¬â¢t said to use condoms to prevent pregnancy. Issues also attract the said bill. First, is about the legislation of the bill, if it was really relevant here in the country with regards to overpopulation, Availability/Provisions for RH information and healthcare for mothers and children. Another issue is if the RH Bill is moral, if the Church must interfere with the State and if the government is willing to give funds to the bill. Third, is about the consequence of a widespread of contraceptives with regards to health and sexual behavior. The last is concerned in the need of sex education in the country. The CBCP together with the national Church felt that it was time to educate again its faithful and made efforts on counteracting the bill. The Church turned offering masses, praying for the enlightenment of congressmen and women and explained that principles of the bill undermine the sanctity of life and marriage. They stated that overpopulation was not the problem but corruption and the unequal distribution of people. They seek to get online, and used CBCP for Life for addressing the matter and let the Simbang Gabi 2012 be used for educating the faithful. They also made catechisms with themes regarding the RH. Meanwhile, pro-woman and pro-RH group also organize plans for the bill. They have tied violet ribbons on their arm signifying their fight against HIV-AIDS. Informed people about gender inequality, maternal deaths, teenage pregnancy and HIV-AIDS and that the bill would help minimize or eliminate such problems. UNESCO and WHO also promotes the education of youths regarding reproductive health. They state that benefits such as a delay in sexual initiation; reduction of unwanted pregnancies, child abuse and abortion; and a slower spread of HIV could be obtained. It can also induce progress to gender equity, social participation and partnership. It prepares the youths for responsibility as adults, emphasizes health promotion and can improve relevance in education systems. Meanwhile, the Catholic Church holds its deposit of faith centered on Divine Love and Unity in Marriage. Its Catechism says that Marriage is by which a man and a woman establish intimate communion for life which is ordered for the good of the spouse and the procreation and education of children,(1660, Catechism of the Catholic Church). It also states that the total reciprocal self-giving is overlaid through contraception for it is a refusal for the total giving of self through taking away openness to life,( 2370,Catechism of the Catholic Church). It states that even intercourse with a legitimate wife but taking away the power to generate life is contrary to Godââ¬â¢s will and leaves guilt of a grave sin,(55-56, Casti Connubii). The Church also teaches the virtue of chastity, that the couple must exercise conjugal love and fidelity and that of safeguarding life form the moment of conception, (51, Gaudium et Spes). She teaches that Marriage can never justify sexual intercourse which is contraceptive which oppose to its true meaning and that artificial methods could lead to marital infidelity and lowering moral standards, reduction of woman as mere object of satisfaction and intervening of public authorities to the most personal and intimate responsibilities of couples, (14,17; Humanae Vitae). Critical Thinking and Sexual Decision Making Essay
Answer the following: How do you use the principles of critical thinking in making sexual decisions? Give an example from your own life in which you would use critical thinking to make a decision about sex. Answer with a minimum word count of 200 words. When anticipating what principles of critical thinking in sexual decisions I use it depends on the situation. I need to take into consideration if I am single or in a relationship, also how long I been single or in a relationship for. These things are key factors in how my sexual decision critical thinking is affected. I will use past experiences of when I was single and how I acted are reacted to sexual encounters that that were affected because of my decisions that I made. I have never been the type of person that was going to wait till marriage for sex. My shyness though made it hard for me to experience my first sexual experience. This was due to the decisions I made I was scared of the subject, but acted as if I was not. When I first experienced sex my whole perspective changed, and this altered my decision making for the worse. I was the type of guy before sex that was still caution and always had a condom for protection, just in case it was needed. I did not date much so after the first encounter it was more of something that would happen on occasion. Mt decision making was poorly and my judgments were clouded for the worse. I had no self-respect for myself or the girls I just wanted to get me some. This in return lead me to many problems because I was careless with who I was having sex with protected and unprotected I had no respect for anyone. When I was single and in that time of my life I was experimenting and learning. When I became in a relationship for a short time it made me develop little self-control and respect for myself. Being in a short term relationship though it did not change the fact that I was a human, and in my mind it is human behavior be dominant. This meant that I did not care about occasionally having a affair with the girl that I was with. I felt it was all right because it was in the human nature. Unfortunately that type of attitude stabbed me in my back and my actions got back to me. The girl cheated on me back and I felt ashamed and hurt that she would do that to me. This helped me realize that I was in the wrong and altered my decision making. I am in the present now, and I am in a long termà relationship where my critical thinking in sexual decisions plays a huge role in us staying together. I could be the immature person I was years ago when first introduced to sex, but that would lead me nowhere. A long tern relationship revolves around trust and cheating and being dishonest breaks that trust, and you are left with nothing. I can say the relationship I am in today is all because of my past experiences and learning from my mistakes in the past. I have a daughter now at the age of 22, so I know how important it is to have safe sex. I am responsible now, and do not need another child not till later in life. I have learned that everyone has feelings and cheating is not being dominant, but hurting yourself and the one you are doing it to. The greatest thing I have learned is it is not always what you want, and sometimes you need to change your mood to make your partner happy. After all it is a relationship that means it involves keeping you are your partner happy.

TUTORIAL CHAPTER : MALAYSIAN LEGAL SYSTEM. Q1) The Federal Court is the highest court in Malaysia. The Federal Court may hear appeals of civil decisions of the Court of Appeal where the Federal Court grants leave to do so. The Federal Court also hears criminal appeals from the Court of Appeal, but only in respect of matters heard by the High Court in its original jurisdiction i. e. where the case has not been appealed from the Subordinate Courts. The Court of Appeal generally hears all civil appeals against decisions of the High Courts except where against judgment or orders made by consent.In cases where the claim is less than RM250,000, the judgment or order relates to costs only, and the appeal is against a decision of a judge in chambers on an interpleaded summons on undisputed facts, the leave of the Court of Appeal must first be obtained. The Court of Appeal also hears appeals of criminal decisions of the High Court. It is the court of final jurisdiction for cases which began i n any subordinate courts. Somewhat like the former Quarter Sessions in England, the Sessions Courts have jurisdiction to try offences which are not punishable by death.They are presided over by Sessions Court judges (formerly Sessions Court Presidents). The Sessions Courts also hear all civil matters of which the claim exceeds RM25,000 but does not exceed RM250,000, except in matters relating to motor vehicle accidents, landlord and tenant and distress, where the Sessions Courts have unlimited jurisdiction. The doctrine of Judicial Precedent works in two ways, vertically and horizontally. Doctrine of judicial precedents works in vertically with the superior courts bind all courts subordinate to it.In horizontally, it works with the courts that usually an appellate court is bound by its own previous decision. First,vertical doctrine shows the Superior Courts which include Federal Court, Court of Appeal and High Court. It also contains the subordinate courts which are Sessions Court, Magistratesââ¬â¢ Court, Juvenile Court and Penghuluââ¬â¢s Court. Horizontal doctrine shows the flow from High Court which is Federal Court to the lower court that is Penghuluââ¬â¢s Court. It is bound by its own previous decision, of its predecessors and coordinate jurisdiction.Second, judicial Decisions can be found in the High Court, Court of Appeal and the Federal Court and the then Supreme Council, Federal Court and the Judicial Committee of the Privacy Council. Decisions of these courts are still being made, systematically by the use of what is called the ââ¬Ëdoctrine of binding judicial precedentââ¬â¢. Judges do not decide cases randomly. They follow certain accepted principles commonly known as precedents. Precedents are basically decision made by judges previously in similar situations.For example The Federal Court (Superior Court in Malaysia) have decided that a minor or those who below 18 years of age, is not liable under a contract. If a minor is sued in Hig h Court for not fulfilling his obligation in a contract, the High Court will follow previous decisions made by the Federal Court. If a judge applies existing rules without extending it, his decision may be called a declaratory precedent; whereas if the case before him is without precedent, then the decisions made by him are called an original precedent.Because of the way the judging is done, judges are constantly contributing to the growth of unwritten law in this country. Q2) Written law refers to the laws contained in the Federal and State Constitutions and in a code or a statute. The written laws are much influenced by English laws as the Malaysian legal system retains many characteristics of the English legal system.. The ââ¬Å"Written lawâ⬠includes the Federal and State Constitution, Legislation and Subsidiary Legislation. Malaysia is a federation of 13 states with a Federal Constitution and 13 State Constitution.The Federation Constitution is the supreme law of the coun try. The Federal Constitution also provides for the ââ¬Å"Yang di-Pertuan Agongâ⬠who owes his position to the Constitution and act accordance with it. The Constitution can only be changed by a two-thirds majority of the total number of members of the legislature. The Federal Constitution comprises many Articles concerning the religion of the federation and many other related subjects. Besides the Federal Constitution, there is a state constitution where each state has their own constitution regulating the government of that state.Legislations refers to the laws that are established by the Parliaments at federal level and by the State Legislative Assemblies at the state level. The Parliament and State Legislatures are not supreme and so they have to enact laws subject to the provisions set out in the Federal and State Constitution. In the Federal Constitution, Article 74, it states that parliament may make law with referring to matters provided in the List I of the Ninth Sched ule while the state legislatives may make law with referring to matter provided in List II.As for matters on List III which is the Concurrent list, are in the authority of both parliament and state legislatives. Matters that are not in the lists are within the authority of the States. Subsidiary Legislations are made by the people or bodies who are authorized by the legislatures. The Interpretation Act 1967 defines subsidiary legislation as rules, regulations, by laws, order, notifications made under legislations. The Legislatures provide basic law, so subsidiary legislation is very important is unsufficient to govern day-to-day matters. That is why the authority is delegated to delegate their legislative powers.In Article 150 of Federal Constitution, Parliament can pass the power to legislate any subsidiary legislation during emergency, even if there are any contradictions with the Federal Constitutions involved. The people or bodies who are authorized by the legislatures are the Y ang di-Pertuan Agong who is the nominal head of the executive and the Prime Minister and cabinet is the real executive. The Cabinet is answerable to the Yang di-Pertuan Agong as the nominal head of the executive in the country. However, according to the democratic ruling system, the Chief Executive is the Prime Minister.This does not mean that the Yang di-Pertuan Agong is unable to voice any opinion, but rather that he must act on government advice, whatever his personal view might be. The Yang di-Pertuan Agong appoints a Cabinet to advise him on country's matter. The Cabinet consists of the Prime Minister and a number of Ministers who must all be members of Parliament. Besides that, the Government has set up various agencies to ensure the smooth enforcement of the law. It comprised of three main components, namely ministries, departments and statutory bodies.Lastly, Islamic law is also a major source of Malaysian law which is enacted under the Federal Constitution. It is only appli cable to Muslims and is administered by a separate court system, the Syariah Courts. The State legislature has authority over the constitution, organization and procedure of the Syariah Courts and is also allowed to make Islamic laws pertaining to persons professing the religion of Islam. Q3) The Unwritten law does not mean that the law is literally unwritten. It refers to the laws which are not enacted by the Legislature and which are ot found in the Federal and State constitutions. This category of law comes from cases decided by the Courts and the local customs, which is otherwise known as common law. The unwritten law mainly comprised of the English law, judicial decisions and custom law. The English Law can be divided into two which are the English Commercial Law and English Land Law. In section 5(1) of the Civil Law Act 1956 provides that The English Commercial Law is applicable in Peninsular Malaysia except Penang and Malacca as it stood on 7 April 1956 in the absence of loca l legislation.On the other hand, Section 5(2) of the same act, applies in Penang, Malacca, Sabah and Sarawak as the law administered in these states will be the same as law administered in England, in the like case at corresponding period. As for the English Land Law, none of the English Land Law concerning the tenure, conveyance, assurance of or succession to any immovable property or any estate, right or interest therein applies in Malaysia. In Malaysia, National Land Code is the law that governs the land matters.There is no any allowance for English land law, except in so far the National Land Code might expressly provide. Approaching the judicial decision, judges do not decide arbitrarily. Instead, they are bound to follow certain accepted principles known as precedents. Precedents are defined as ââ¬Ëa judgment or decision of a court of law cited as an authority for the legal principle embodied in its decisionâ⬠. The system of binding judicial precedent is called stare d ecisis. It is created by the English judges and introduced into Malaysia upon colonization.The Malaysian Court system is similar and in fact, influenced by the English Court system which is divided into the Superior and Subordinate Courts. Under the Subordinate Courts, the Penghulu Court is the lowest level and the state government will appoint a headman to preside the court for the specific district. Relating Sabah and Sarawak, both are equally related to the Native Courts that relates to the indigenous people's customs. A level above is the Magistrate's Courts which deals with minor criminal and civil cases and at the highest level are the Sessions Courts.However, the Superior Courts are made up of the High Court, Court of Appeal and Federal Court (which is the highest court in the land). Customs are another important source of unwritten law. Every race has its own customs. Hindu and Chinese customary law applied to the Hindus and Chinese respectively. Besides that, natives in Sab ah and Sarawak have their own customary law which relates to the land and family matters. In Malaysia, there are two types of Adat which is the Adat Perpateh and Adat Temenggung.Adat Perpateh is practiced among the Malays in Negeri Sembilan and Nanning in Malacca. It uses the matrilineal system which belongs to mother's lineage, meaning to say it involves the inheritance of property, names or titles from mother to daughters. It also concerns with matters such as land tenure, lineage, inheritance and election of members of lembaga and Yang di-Pertuan Besar. As for Adat Temenggung, it is practiced in other states and it uses the patrilineal system which belongs to father's lineage.
